The Ministry of Commerce and the General Administration of Customs have announced the decision to impose export controls on certain items related to medium and heavy rare earths

In accordance with the relevant provisions of the Export Control Law of the People's Republic of China, the Foreign Trade Law of the People's Republic of China, the Customs Law of the People's Republic of China, and the Regulations on the Export Control of Dual-Use Items and Technologies of the People's Republic of China, and in order to safeguard national security and interests and fulfill international obligations such as non-proliferation, with the approval of the State Council, it is decided to impose export control on the following items:

I. 1C909 Holmium-related items

(1) 1C909.a. Holmium metal, holmium-containing alloys and related products:

1. Holmium metal (Reference tariff code: 28053019).

2. Holmium-containing alloys:

a. Holmium-copper alloy;

b. Magnesium-holmium alloy;

c. Holmium-iron alloy.

3. Holmium-containing targets:

a. Holmium target;

b. Holmium-copper alloy target.

4. Holmium-containing permanent magnetic materials.

Explanation:

1.1C909.a.2, 1C910.a.2, and 1C912.a.2 regulate alloys in forms such as ingots, blocks, strips, wires, sheets, rods, plates, tubes, particles, and powders.

2.1C909.a.3, 1C910.a.3, 1C911.a.2, 1C912.a.3, and 1C913.a.2 regulate target materials in forms such as sheets and tubes.

3.1C909.a.4 regulates permanent magnetic materials including magnets or magnetic powders.

4.1C909, 1C910, 1C911, 1C912, and 1C913 regulate oxides, compounds, and their mixtures in forms such as powders, etc.

Exporters of the aforementioned items shall apply for permission from the State Council's Commerce Department in accordance with the relevant provisions of the "Export Control Law of the People's Republic of China" and the "Regulations of the People's Republic of China on the Export Control of Dual-Use Items".

Exporters are responsible for the authenticity of the declared goods at the customs declaration stage. They should enhance the identification of export items. If the items are controlled items, they must indicate "belonging to dual-use items" in the remarks column of the customs declaration form and list the export control codes of dual-use items; if they are not controlled items but have similar parameters, indicators, performance, etc., they must indicate "not belonging to controlled items" in the remarks column of the customs declaration form and fill in the specific parameters, indicators. For the above-mentioned information on filling in, if there are doubts about completeness, accuracy and authenticity, the customs will legally raise questions. During the questioning period, the exported goods will not be released.

This announcement will come into effect on November 8, 2025. The "List of Dual-Use Items for Export Control of the People's Republic of China" will be updated simultaneously.
